3. When these terms apply
These terms apply to every offer on combibag.com and to every contract between you and us. Before you place an order, these terms are available on this page, where you can save or print them. We also send them with your order confirmation.
If you are a consumer, nothing in these terms limits the rights you have under the mandatory consumer law of the country where you live. If a provision of these terms is invalid, the other provisions remain in force.
4. Products and prices
We describe and photograph every product as accurately as we can. Most of our bags are one of a kind, and the photos show the actual piece. Colours can look slightly different on different screens.
Obvious mistakes in our offer, such as a clearly incorrect price, do not bind us. If such a mistake affects your order, we contact you and you can cancel the order free of charge.
All prices are in euros and include VAT. Delivery costs are shown separately before you place your order. An offer is valid while the product is available. Because each piece is unique, the first completed order for a piece gets it.
5. How the contract is made
The contract is concluded when you place your order by clicking Place order and pay and complete the payment. We confirm receipt of your order by email without delay.
If a product turns out to be no longer available, for example because two orders for the same piece arrived at almost the same moment, we tell you as soon as possible and refund the full amount within 14 days. The contract for that product then ends.
We may refuse or cancel an order for a legitimate reason, such as suspected fraud. If we do, we tell you and refund any payment within 14 days.
The contract is concluded in English. We store your order details and send you a copy in the order confirmation.
6. Payment
You pay when you place your order, using one of the payment methods shown at checkout: iDEAL, Bancontact, Visa, Mastercard, American Express, Apple Pay, Google Pay, PayPal. Payments are processed by Stripe Payments Europe, Limited and PayPal (Europe) S.à r.l. et Cie, S.C.A. We do not receive or store your full card details.
Card payments may require extra authentication by your bank (3-D Secure). Charges appear on your bank or card statement as COMBIBAG.COM. If a payment fails or is cancelled, we do not process the order.
7. Delivery
We deliver to addresses in all EU member states. Delivery costs and estimated delivery times are listed on our shipping page and shown at checkout.
We ship within 1–2 business days after payment. Delivery times are estimates. We deliver no later than 30 days after the contract is concluded, unless we agree a different delivery time with you.
If delivery is delayed or a product cannot be delivered, we tell you no later than 30 days after you placed the order. You can then cancel the order free of charge, and we refund you within 14 days.
The risk of loss of or damage to the products passes to you when you, or a third party you have named other than the carrier, receive them.
8. Right of withdrawal
As a consumer, you can withdraw from the contract within 14 days without giving a reason. The period starts on the day after you, or a third party you have named other than the carrier, receive the product. If one order is delivered in several parcels, the period starts on the day after you receive the last one.
We voluntarily extend this period to 30 days after delivery. This extension does not affect your statutory rights.
To withdraw, use the withdrawal function on our website, labelled Withdraw from contract here. We confirm receipt by email. You can also send us the model withdrawal form or another clear statement by email or post. It is enough to send your statement before the period ends.
9. Returning items
Send the product back within 14 days after you tell us you are withdrawing. You meet this deadline if you send the product before the 14 days have passed. We send you the return address and instructions when we confirm your withdrawal.
You pay the direct cost of returning the product, unless it is faulty or not what you ordered.
During the withdrawal period, handle the product only as you would in a shop to check what it is, its characteristics and how it works. If you handle it beyond that, you are liable for any reduction in its value. Please return the product in its original packaging where possible. This is not a condition for withdrawing.
10. Refunds
Within 14 days after we receive your withdrawal notice, we refund all payments you made, including the cost of standard delivery. If you chose a more expensive delivery method, we do not refund the extra cost of that method.
We may wait with the refund until we have received the product back or you have shown proof that you sent it, whichever comes first. We refund using the same payment method you used, unless you expressly agree to something else. You do not pay any fees for the refund.
11. Exceptions to the right of withdrawal
The right of withdrawal does not apply to products made to your specifications or clearly personalised, such as a custom piece made from your own boots. We mark such products clearly before you order.
12. Conformity and statutory guarantee
Our products conform to the contract, the specifications in our offer, reasonable requirements of soundness and usability, and the legal provisions that apply on the date of the contract.
Many of our bags are made from vintage leather. Natural marks, creases and colour differences that are visible in the photos or mentioned in the description are characteristics of the piece, not defects.
If a product does not conform to the contract, you are entitled to repair or replacement. If that is not possible or reasonable, you are entitled to a price reduction or to end the contract. A defect that appears within one year after delivery is presumed to have existed at delivery, unless this is incompatible with the nature of the product or the defect. Please tell us within two months after you discover a defect.
Normal wear and tear, improper use and damage from not following the care instructions are not defects. Any additional guarantee from us or the manufacturer does not limit your statutory rights.
13. Complaints and disputes
If you are not satisfied, email us at [email protected] with your order number, a description of the problem and, where useful, photos. We confirm receipt within one business day and give you a full answer within 14 days. If we need more time, we tell you within those 14 days when you can expect an answer.
If we cannot solve your complaint together, you can get information from ConsuWijzer, the consumer information service of the Netherlands Authority for Consumers and Markets (ACM). If you live in another EU country, the European Consumer Centre in your country can help with cross-border complaints. You can also take the matter to court.
We are not affiliated with an alternative dispute resolution body and are not obliged to use one.
14. Liability
We are liable as provided by law. Nothing in these terms excludes or limits our liability for intent or gross negligence, or any liability that cannot be excluded or limited under mandatory law.
We are not liable for delays or failures caused by circumstances beyond our reasonable control, such as strikes, natural disasters or carrier disruptions. If such a circumstance affects your order, we tell you, and you can cancel the order and receive a full refund.
15. Personal data
We process your personal data as described in our privacy policy.
16. Intellectual property
The content of this website, including texts, photos and design, belongs to us or our licensors and may not be used without permission. Brand names of the products we sell belong to their respective owners.
17. Changes to these terms
We may change these terms. The version that applied when you placed your order applies to that order.
18. Applicable law and disputes
These terms and every contract with us are governed by Dutch law. If you are a consumer living in another EU country, you keep the protection of the mandatory provisions of the law of that country.
Disputes are submitted to the competent court in the Netherlands, unless mandatory law gives you the right to bring the dispute before the court where you live.
